Digital Millennium Copyright Act (DMCA) Policy

 

Overview

We respect the intellectual property rights of others and expect the same in return. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), copyright owners or their authorized agents may submit valid takedown requests to our designated DMCA Agent. As an online service provider, we operate under the DMCA’s “safe harbor” protections.

 

Notice of Infringement

To submit a valid DMCA infringement notice, you must provide the following information:

  1. A physical or electronic signature of the copyright owner or the person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material to be removed, including sufficient information for us to locate the material. Providing the exact URL is strongly recommended.
  4. Your full contact information, including name, physical address, email address, and phone number.
  5. A statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  7. A statement confirming that your claim is submitted under penalty of perjury in compliance with the DMCA.

Misrepresentations in a DMCA notice may result in liability for damages under 17 U.S.C. § 512(f).

 

Counter Notification

If your material has been removed due to a DMCA notice, you may submit a counter notification containing:

  • Your physical or electronic signature.
  • Identification of the material that was removed and its original location before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed due to a mistake or misidentification.
  • Your name, address, and phone number, along with a statement consenting to the jurisdiction of the federal district court for your location (or any district where we may be found if you are outside the United States). You must also agree to accept service of process from the person who submitted the original infringement claim.
  • Submission of your counter notice through our Contact page. Email is recommended for fastest handling.

Safe Harbor Disclaimer

Under the DMCA’s safe harbor provisions, we are not liable for copyright-infringing content posted by users or third parties, provided we act promptly to remove or block access to material upon receiving proper DMCA notification. We do not monitor user content for copyright violations and rely on rights holders to notify us of infringing material.

 

Repeat Infringer Policy

We maintain a record of DMCA notices and make a good faith effort to identify repeat infringers. Any user found to be a repeat infringer under our internal policy will have their access or account permanently terminated.
